What is a trademark?
A trademark is defined as a word, phrase, or design that identifies your goods or services or of someone else’s. When someone comes to look at you in the market, they will have an identifying something that separates you from others. A federal trademark gives you exclusivity when you have successfully applied and achieved registration. It will give you protection outside of your home state, in all 50 states.
Ask yourself the three questions below if you are considering if now is a good time to trademark.
Is that of concern to you? If it is a concern to you, let’s talk about federal trademark.
Can it earn me money in the future? This means that if you have a hot commodity that you will want to trademark it with the intent to use it. If you want to do the intent to use, we can discuss that more.
If people can identify you for this particular phrase, slogan, sound, etc. and you are the only one in the space using it or if each time someone hears it, they think of your goods or services, IT IS TIME! It is time for you to trademark what you are doing and what people are recognizing you for. The reason to do this is that if people are identifying you for that phrase, slogan, etc. and you have not achieved federal trademark status, someone could get to the door before you. If you wait too long, you will regret it.
